Terms of Service

1. Acceptance of Terms

By downloading, installing or using AllBusApp (the "App"), you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the App.

2. Eligibility

You must be at least 13 years old to use AllBusApp. By agreeing, you represent that you're at least 13 and able to form a binding contract under your local laws.

3. License & Use

• What you get: We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on any iOS device you own.
• What you don't get: No reverse-engineering, copying, distributing, sublicensing or commercial use beyond what we explicitly allow.

4. App Usage

• Location Services: The App uses your device's location to find nearby bus stops and provide transit information.
• Offline Functionality: Some features work offline using cached transit data.
• No Account Required: AllBusApp does not require user registration or accounts.

5. In-App Purchases & Billing

• Free vs. Ad-Free: Basic features are free with advertisements. Ad removal is available via one-time purchase.
• Payments: Handled via Apple's In-App Purchase. All billing, refunds, and purchases follow Apple's policies—reach out to Apple for billing issues.
• Permanent Purchase: Ad removal is a one-time purchase that permanently removes ads from the App.

6. Transit Data & Compliance

• Data Sources: Transit data is provided by Oahu Transit Services (TheBus), County of Maui (Maui Bus), and County of Kauaʻi (Kauai Bus).
• Accuracy: We make reasonable efforts to provide accurate transit information, but cannot guarantee real-time data accuracy due to factors beyond our control.
• Service Interruptions: Transit data may be temporarily unavailable due to source system maintenance or technical issues.

7. Intellectual Property

All content, UI, code, trademarks and logos in AllBusApp are owned by Kanto Projects or our licensors. Transit data remains property of respective transit agencies. Don't copy or steal our intellectual property.

8. User-Generated Content & Feedback

Any suggestions, bug reports, feedback, or other communications you send us become our property and may be used without restriction or attribution to improve the App.

9. Prohibited Conduct

You agree not to:

• Abuse, hack, reverse-engineer or disrupt AllBusApp or transit agency services
• Use the App to interfere with public transportation systems
• Provide false location data or manipulate GPS information
• Use the App for unlawful purposes or to violate any third-party rights
• Attempt to circumvent ad-blocking purchase mechanisms

10. Termination

We can suspend or terminate your access at our discretion—say, for a Terms breach. You can stop using the App by uninstalling it from your device. Your purchase of ad removal will remain valid even if you reinstall the App.

11. Disclaimers & "As-Is"

AllBusApp is provided "as-is." We make no warranties—express or implied—about uptime, accuracy of transit data, or fitness for a particular purpose. Transit schedules and real-time data depend on third-party sources. Use at your own risk.

12. Limitation of Liability

To the max extent allowed by law, Kanto Projects and its affiliates won't be liable for any indirect, incidental, special, punitive, or consequential damages—including missed buses, delayed travel, or any transportation-related issues—even if advised of the possibility. Our total liability to you for any claim under these Terms is limited to $50.

13. Indemnification

You agree to defend, indemnify, and hold harmless Kanto Projects against any claims, damages or expenses arising from your misuse of AllBusApp or violation of these Terms.

14. Transit Agency Relationship

AllBusApp is an independent third-party application. We are not affiliated with, endorsed by, or officially connected to TheBus, Maui Bus, Kauai Bus, or their respective governing agencies. All transit-related complaints or issues should be directed to the appropriate transit agency.

15. Governing Law

These Terms are governed by Hawaiʻi law, without regard to conflict-of-law rules. Any disputes go to state or federal court in Honolulu, HI.

16. Changes to These Terms

We may update these Terms occasionally. If there's a material change, we'll highlight it in-app and post the new Terms here at least 7 days before they take effect. Your continued use after that date means you agree.
